Thomas Ryan, Esq., managing partner and Chair of Laddey, Clark and Ryan’s Employment and Labor Practice Group, recently appeared as a panelist at a seminar on Keeping Pace With Employment Law presented by the Morris County Bar Association.

Ryan specifically spoke on Worker Classification Issues in reviewing the state and federal employment laws as they pertain to classification of workers as either independent contractors or employees. He covered the Fair Labor and Standards Act; Economic Realities Test; the Internal Revenue Service (IRS); Control Test; and the Relative Nature of the Work Test that is utilized by the New Jersey Department of Labor.

The presentation was in response to recent crackdowns by the New Jersey Department of Labor on wrongfully classified employees that have resulted in significant back pay, fines and other penalties being imposed upon small, mid-size and large employers.

His area of expertise includes representation of management and individuals in both the private and public sectors, in all aspects of Employment and Labor Law. He has extensive experience in employment discrimination, wrongful termination, discipline, breach of contract, harassment, wage and hour, collective bargaining and other employment related issues.

Ryan also reviews and prepares personnel policies and handbooks, conducts investigations into employee complaints, provides harassment and discrimination training and counsels clients on all employment issues. Ryan’s practice also includes commercial litigation, business and municipal law.

Ryan was recently named one of New Jersey Monthly’s Super Lawyers for the sixth year in a row. He is a member of the Labor and Employment Law Section of the New Jersey State Bar Association, and a Master in the prestigious Sydney Reitman Employment Law Inn of Court.
