Sussex plans study of old cookie factory

    The Sussex Borough unanimously authorized Sussex Borough Professional Planner Kenneth P. Nelson to complete a study regarding the old Weibel Cookie Factory and area across the street on Oct. 7.

    Councilman Salvatore Lagattuta abstained, and Councilwoman Annette Stendor was absent.

    Borough Attorney Francis J. McGovern said the resolution would authorize Nelson to review the lots, according to New Jersey law, and refer the results to the Planning Board. Nelson's findings could then result in extra incentives for developers.

    Mayor Jonathan Rose said Nelson would determine if the lots should be changed to a "non-condemnation redevelopment area” instead of being zoned as a “rehabilitation area”. According to state law, “non-condemnation redevelopment areas” have a longer PILOT (payment in lieu of taxes) period and more stringent rules than a rehabilitation zone."

    According to a state law passed in September 2013, municipalities cannot use eminent domain on a “non-condemnation redevelopment area”, at first. The act allows municipalities to later reclassify the “non-condemnation redevelopment area” as a “condemnation redevelopment area," which would allow for eminent domain.
