Sean McNicholas, 59, of Stockholm was charged with driving under the influence July 30 after a one-car accident.

Patrolman Andrew Spitzer responded to a report of the accident on Main Street and found that a Toyota Corolla ran off the road to the right before striking a utility police. That caused the vehicle to roll over, then land upright in the opposite lane of travel.

Spitzer located the driver, McNicholas, walking nearby. While speaking with him, the officer saw signs of impairment, which he suspected to be narcotic impairment, police said.

Further investigation showed that McNicholas had discarded a bottle of oxycodone in a bush near the accident before police arrived. He admitted that he had taken the oxycodone earlier in the day and hid the bottle to avoid getting in trouble, police said.

McNicholas was taken to a medical facility to be evaluated. A search warrant was obtained, and samples of blood and urine were collected and sent to the New Jersey State Police lab for toxicology.

He also was charged with careless driving, reckless driving and failure to maintain traffic lane.

He was released pending an appearance in the Sparta Municipal Court.
